IMPORTANT — PLEASE READ THIS DISCLAIMER CAREFULLY BEFORE USING THE SAFEOPSHUB SDS MANAGEMENT PLATFORM.

1. Platform Description

SafeOpsHub LLC ("SafeOpsHub," "we," "us," or "our") provides a cloud-based digital Safety Data Sheet (SDS) management platform (the "Platform") that allows organizations to upload, store, organize, search, and manage Safety Data Sheets and related workplace safety documentation. The Platform also includes features such as AI-powered data extraction, hazard label generation, QR code access, chemical risk assessments, and compliance reporting tools.

The Platform is a document management tool designed to assist organizations in organizing their safety documentation. It is NOT a regulatory compliance service, safety consulting firm, or substitute for professional safety guidance.

2. SDS Document Accuracy

SAFEOPSHUB DOES NOT AUTHOR, CREATE, VERIFY, VALIDATE, OR GUARANTEE THE ACCURACY, COMPLETENESS, OR CURRENCY OF ANY SAFETY DATA SHEET UPLOADED TO OR STORED ON THE PLATFORM.

Safety Data Sheets are authored by chemical manufacturers, importers, and distributors as required by OSHA's Hazard Communication Standard (29 CFR 1910.1200). The accuracy and completeness of SDS content is the sole responsibility of the SDS author and the employer who maintains the document.

Users are solely responsible for:

  • Ensuring that all SDS documents uploaded to the Platform are accurate, complete, and current.
  • Obtaining updated SDS documents from manufacturers when chemical formulations, hazard classifications, or regulatory requirements change.
  • Verifying that SDS documents conform to the 16-section GHS format required by OSHA.
  • Removing or replacing outdated, superseded, or inaccurate SDS documents in a timely manner.

3. AI-Extracted Data and Generated Content

The Platform uses artificial intelligence (AI) technology to extract structured data from uploaded SDS documents, including but not limited to: chemical identifiers, hazard classifications, GHS pictograms, first-aid measures, personal protective equipment (PPE) requirements, NFPA ratings, and HMIS ratings.

AI-EXTRACTED DATA IS PROVIDED FOR CONVENIENCE AND INFORMATIONAL PURPOSES ONLY.

AI extraction technology, while advanced, is not infallible. Extracted data may contain errors, omissions, misinterpretations, or inaccuracies due to variations in SDS formatting, document quality, language complexity, or limitations of the AI model.

Users MUST independently verify all AI-extracted information against the original SDS document before relying on it for any purpose, including but not limited to:

  • Workplace safety decisions and hazard assessments.
  • Selection of personal protective equipment (PPE).
  • Emergency response planning and procedures.
  • Chemical storage and compatibility determinations.
  • Regulatory compliance documentation.
  • Employee training and hazard communication.

4. Generated Labels and Reports

The Platform generates various labels and reports based on AI-extracted SDS data, including:

  • GHS Labels — Globally Harmonized System of Classification and Labelling of Chemicals labels.
  • NFPA 704 Diamonds — National Fire Protection Association hazard identification labels.
  • HMIS Labels — Hazardous Materials Identification System labels.
  • Secondary Container Labels — Labels for secondary containers with QR code access.
  • Chemical Risk Assessment Reports — AI-generated risk assessment summaries.
  • Compliance Reports — SDS inventory, gap analysis, and OSHA readiness reports.

ALL GENERATED LABELS AND REPORTS ARE BASED ON AI-EXTRACTED DATA AND ARE PROVIDED FOR INFORMATIONAL PURPOSES ONLY. THEY ARE NOT GUARANTEED TO BE ACCURATE, COMPLETE, OR COMPLIANT WITH ANY REGULATORY STANDARD.

Users are solely responsible for verifying the accuracy of all generated labels and reports before use in the workplace. Incorrect labels or reports could result in serious injury, illness, or death.

5. Employer Responsibilities Under OSHA Hazard Communication

Under OSHA's Hazard Communication Standard (29 CFR 1910.1200), employers bear the primary responsibility for maintaining accurate and current Safety Data Sheets for all hazardous chemicals present in the workplace. This includes, but is not limited to:

  • Maintaining a complete and current SDS for each hazardous chemical used, stored, or produced in the workplace.
  • Ensuring that SDS documents are readily accessible to employees during each work shift.
  • Developing and maintaining a written Hazard Communication Program.
  • Ensuring that all containers of hazardous chemicals are properly labeled.
  • Providing employees with information and training about hazardous chemicals in their work area.
  • Updating SDS documents when new information becomes available from chemical manufacturers.

The SafeOpsHub Platform is designed to assist employers in meeting these obligations by providing digital tools for SDS storage, organization, and access. However, use of the Platform does NOT relieve employers of their independent duty to comply with all applicable OSHA requirements.

6. Data Storage and Availability

SafeOpsHub uses commercially reasonable measures to ensure the availability and integrity of data stored on the Platform. However:

  • SafeOpsHub does not guarantee uninterrupted access to the Platform or stored documents.
  • Service interruptions may occur due to maintenance, updates, technical issues, or circumstances beyond our control.
  • Employers should maintain backup copies of critical SDS documents and should not rely solely on the Platform as their only means of SDS access.

OSHA requires that SDS documents be "readily accessible" to employees. Employers should have contingency plans for SDS access in the event of internet outages, power failures, or Platform unavailability.

7. Limitation of Liability

SAFEOPSHUB LLC SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO:

  • Inaccurate, incomplete, or outdated SDS documents stored on the Platform;
  • Errors in AI-extracted data, generated labels, or generated reports;
  • Workplace accidents, injuries, illnesses, or fatalities;
  • OSHA citations, fines, penalties, or enforcement actions;
  • Failure to comply with OSHA Hazard Communication Standard or any other regulation;
  • Reliance on any information provided through the Platform;
  • Unavailability of the Platform or stored documents;
  • Loss or corruption of uploaded data.

THIS LIMITATION APPLIES REGARDLESS OF THE THEORY OF LIABILITY AND EVEN IF SAFEOPSHUB HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

8. Disclaimer of Warranties

THE PLATFORM AND ALL ASSOCIATED FEATURES, INCLUDING AI DATA EXTRACTION, LABEL GENERATION, RISK ASSESSMENTS, AND COMPLIANCE REPORTS, ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.

SafeOpsHub does not warrant that: (a) the Platform will meet your specific compliance requirements; (b) AI-extracted data will be accurate or complete; (c) generated labels will comply with applicable labeling standards; (d) the Platform will be available without interruption; or (e) use of the Platform will result in regulatory compliance.

9. Governing Law

This Disclaimer shall be governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of law provisions. Any disputes arising from or related to this Disclaimer shall be resolved in the courts of North Carolina.
